The Planning Agreement provides for:
1 Changes to the details of the parties to include the Brewery Yard Purchaser as a
party to the Planning Agreement.
2 The registration of the Planning Agreement over the Brewery Yard and the Lot 50
and for the Planning Agreement to be released from the remainder of the Land
Owner's Land. The land on which the Planning Agreement will be registered is
shown as the Brewery Yard and the land described as Retail and shown hatched on
the plan in Exhibit A to the Further Deed of Amendment.
3 New requirements on the Brewery Yard Purchaser to comply with the Planning
Agreement so far as those rights and obligations apply to the Brewery Yard.
4 Updated references to the Land Owner's Land as described above.
5 Updated references to the Development Contributions Schedule to remove those
items that have been completed.
6 Changes to the timing of the delivery of the embellishment of the Brewery Yard and
the roads and footpaths. The Brewery Yard must now be completed prior to the
issue of any Occupation Certificate for the Brewery Yard or 30 June 2021
(whichever is earlier). The roads and footpaths must achieve practical completion
before 31 December 2018 and an application must be made to dedicate before 30
June 2019.
7 New and updated definitions to support the above amendments.
