Proposed Deed of Variation to an Existing Planning Agreement
Pursuant to section 93G of the Environmental Planning and Assessment Act 1979
You are invited to inspect the following proposed Deed of Variation between the Minister for Planning and Infrastructure and Marloelle Pty Ltd in relation to an existing Planning Agreement associated with:

Development Application [Tamworth Regional Council DA no. 0505/2010] for a 55 residential lot subdivision at Lot 65 DP 1144928, Hills Plain, Tamworth).

The Deed of Variation amends the Planning Agreement between the parties to allow for the grant of a credit for each residential lot for which the levy is paid prior to 30 June 2011, regardless of whether the lot has been created. The credit may only be used against contributions towards State infrastructure that Marloelle Pty Ltd may be required to pay in future in connection with other developments within the Hills Plains Release Area.

A copy of the Deed of Variation, explanatory note and existing Planning Agreement, prepared in accordance with section 93F of the Environmental Planning and Assessment Act 1979, is available for viewing from 16 May 2011 to 13 June 2011.
